1. Who we are

Engadini is the trading name of Daina Phiri, a sole trader providing garden design, planting design and garden maintenance services.

Engadini is based in Sydenham, South East London and is the data controller responsible for the personal information described in this notice.

2. Information we may collect

Website and general enquiries

When you use our website enquiry form, we may collect:

  •  your first name;

  • your email address;

  • your telephone number, where provided;

  • the service you are interested in;

  • information you include in your enquiry, such as your location, garden, proposed project, timescale or requirements;

  • technical information connected with submitting the form, such as the submission date and information needed to operate and secure the website.

You may also give us information when you contact us:

  • by email or telephone;

  • through Instagram or TikTok;

  • through a referral;

  • during a consultation, remote call or site visit;

  • through another direct conversation about our services.

When you communicate through a social-media platform, that platform also processes information under its own privacy terms.

Client and project information

If you ask us to prepare a quotation or become a client, we may also collect and use:

  • your home, correspondence or project address;

  • contact details for other people involved in the project;

  • garden photographs and video;

  • site surveys, dimensions, measurements and plans;

  • information about how the garden is used;

  • design preferences, planting preferences and project requirements;

  • practical or accessibility requirements relevant to the proposed work;

  • project budgets and purchasing information;

  • quotations, proposals, contracts and instructions;

  • project correspondence and notes;

  • invoices, payment records and other accounting information;

  • contractor, supplier or professional-adviser details where relevant to the project.

We aim to collect only information that is reasonably necessary for the enquiry, project or service concerned.

Please do not include medical, financial or other sensitive personal information in a general enquiry unless it is directly relevant and we have asked you to provide it.

3. How and why we use personal information

Responding to enquiries

We use enquiry information to understand what service you may need, respond to your questions, discuss your garden or proposed project, arrange a consultation, call or site visit, and decide whether Engadini is able to assist.

Our lawful basis is usually our legitimate interest in responding to genuine enquiries about our business.

Preparing quotations and proposals

We may use your information to assess the proposed work, prepare a scope, quotation or proposal, arrange preliminary discussions or a site visit, and take other steps you have requested before entering into an agreement.

Our lawful basis is taking steps at your request before entering into a contract.

Providing garden services

Where you become a client, we use relevant information to plan and deliver the agreed service, communicate with you about the project, prepare designs, planting plans or maintenance arrangements, manage changes and approvals, coordinate agreed work involving suppliers or contractors, and issue invoices and administer payment.

Our lawful basis is the performance of our contract with you.

Business, accounting and legal administration

We may retain and use relevant information to maintain business and tax records, manage payments and unpaid invoices, maintain appropriate project records, respond to insurance matters, complaints or disputes, establish, exercise or defend legal claims, and comply with legal and regulatory requirements.

Depending on the purpose, our lawful basis is a legal obligation or our legitimate interests in administering and protecting the business.

Marketing communications

We do not currently operate an email newsletter or add website enquiries to a marketing mailing list.If we introduce email marketing in future, we will explain how it works and obtain consent where required. You will be able to withdraw your consent or unsubscribe at any time.

Photographs, testimonials and promotional material

We may wish to use completed-project photographs, videos, testimonials, designs or project stories on the Engadini website, in social-media content, in a portfolio, in printed marketing materials, or in business presentations and other promotional material.

We will seek separate permission before using an identifiable testimonial, client identity, private address, project story, garden photograph or video for promotional purposes.

Giving this permission is optional and is not a condition of receiving our services.

Where material does not identify an individual or disclose a private address, it may no longer constitute personal information. We will nevertheless aim to use project material respectfully and in accordance with any agreement made with the client.

4. How we receive your information

We normally receive information directly from you.

We may occasionally receive your contact details through someone who has referred you to Engadini, another member of your household, or a professional adviser, contractor or supplier involved in your project.

Where appropriate, we will tell you where the information came from.

5. Who we may share information with

We do not sell or rent personal information.

We may share limited information where reasonably necessary with:

  • website, email and technology providers;

  • accountants, bookkeepers, insurers or professional advisers;

  • contractors or suppliers involved in an agreed project;

  • IT or website support providers;

  • payment or banking providers;

  • public authorities, regulators, courts or law-enforcement bodies where required by law;

  • another party where necessary to establish, exercise or defend legal rights.

We only share information that is relevant to the purpose concerned.

Squarespace

The Engadini website is built and hosted using Squarespace. Squarespace processes website information on our behalf, including information needed to operate and secure the website, manage cookies and analytics, and process enquiry-form submissions.

When you submit the website enquiry form, the submission is delivered to our Proton Mail business inbox. Your name, email address, submission date and related form-submitter information may also be stored in the Contacts and Form Submitters area of our Squarespace account. We use this information only to manage and respond to enquiries and do not treat form submitters as marketing subscribers unless they have separately opted in to receive marketing communications.

Squarespace may process information outside the United Kingdom under its applicable data-processing and international-transfer arrangements.

Proton Mail

Business email is provided through Proton Mail. Website enquiries and subsequent correspondence are delivered to and stored within our Proton business email account at hello@engadini.co.uk.

Proton is based in Switzerland and provides contractual data-protection arrangements for business customers.

6. International transfers

Some of our technology providers may store or process personal information outside the United Kingdom.

Where this occurs, we rely on applicable safeguards, which may include a UK adequacy regulation, approved contractual protections, the provider’s data-processing agreement, or other lawful transfer safeguards recognised under UK data-protection law.

7. How long we keep information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected.

Enquiries that do not become projects

We normally delete or anonymise enquiry information within 12 months of the last meaningful contact. This applies to enquiry records held in both our Proton Mail account and the Contacts and Form Submitters area of our Squarespace account. We may retain a minimal record for longer where necessary to manage repeated contact, a complaint or another legitimate business issue.

Active projects

We keep relevant information for the duration of the project or service.

Routine project material

Duplicate photographs, unnecessary working notes, draft material and other information no longer required will normally be reviewed and deleted within six months after completion or termination.

Core contractual and project records

We may retain contracts, accepted quotations, final designs, key instructions, approvals and relevant correspondence for up to six years after the project or service ends, where reasonably required for contractual, insurance or legal purposes.

Financial and tax records

Invoices, income and expense records and supporting accounting information are retained for the period required by applicable tax and accounting law.

Marketing information

Where you have consented to receive marketing communications, we will retain the relevant contact information until you unsubscribe, withdraw consent or the information is no longer required. We will periodically review marketing records rather than retaining them indefinitely.

Photographs and testimonials

Promotional photographs, videos, testimonials and project stories may be kept while permission remains valid and the material continues to be used.

You may ask us to stop future use. It may not always be possible to retrieve printed material already distributed or content already shared by third parties, but we will stop further use where reasonably possible.

8. How we protect information

We take reasonable technical and organisational measures to protect personal information. These measures include, where appropriate, password-protected business accounts, access controls, reputable website and email providers, limiting access to people who reasonably need the information, keeping devices and software updated, and reviewing and deleting information that is no longer needed.

No internet, website or email system can be guaranteed to be completely secure.

9. Your data-protection rights

Depending on the circumstances, you may have the right to:

·   be informed about how your information is used;

  • request access to personal information we hold about you;

  • ask us to correct inaccurate or incomplete information;

  • ask us to delete information;

  • ask us to restrict how information is used;

  • object to particular uses of your information;

  • request transfer of information in a portable format where the right applies;

  • withdraw consent where processing is based on consent.

Some rights are subject to legal conditions and exemptions. For example, we may need to retain invoices or other information required for tax, contractual or legal purposes.

To exercise a right, contact hello@engadini.co.uk. We will normally respond within one month. We may need to ask for information to confirm your identity before acting on a request.

10. Complaints

Please contact us first if you have concerns about how your information has been handled.

You also have the right to complain to the Information Commissioner’s Office, the UK regulator responsible for data protection. The ICO provides guidance and complaint services through its official website and helpline.

11. Automated decision-making

We do not use personal information to make solely automated decisions about individuals, and we do not carry out automated profiling

12. Cookies and website analytics

Cookies are small files or pieces of information placed on a device when someone visits a website.

Squarespace uses cookies and similar technologies to operate and secure the website, remember visitor preferences, provide website functionality, and measure website traffic and performance where consent is given.

When you visit the website, the Squarespace cookie panel allows you to accept cookies, reject non-essential cookies, or manage preferences by category.

Necessary cookies

Necessary cookies are always active because they support core website functions, security and visitor preferences. They are not used by Engadini for advertising or individual audience profiling. Some necessary cookies may remember choices such as cookie preferences.

Performance and Analytics cookies

Squarespace uses Performance and Analytics cookies to provide information such as visitor numbers, sessions, traffic sources, website usage and performance.

These cookies are switched off unless you choose to enable them through the cookie preferences panel. The information is generally used in aggregated website reports to help us understand how the site is being used.

Advertising cookies

The Squarespace cookie preferences panel contains an Advertising category.

Engadini does not currently use advertising cookies, advertising pixels or third-party behavioural advertising tools on the website. The category is therefore left switched off. If advertising technology is introduced in future, we will update this notice and obtain consent where required before activating it.

13. Changing your cookie choices

You can review or change your choices using the Cookie Preferences control available at the bottom-right of the Engadini website.

You can also block or delete cookies through your browser settings. Blocking necessary cookies may affect how parts of the website work.

14. Links to other websites and social platforms

The website may contain links to external services, including Instagram and TikTok.

Engadini does not control how those external websites or platforms collect and use information. You should review their privacy information before providing personal data through them.

15. Children

Engadini’s services and website are not directed specifically at children.

We do not knowingly use the website to collect personal information directly from children for marketing or profiling purposes.

16. Changes to this notice

We may update this notice where our services change, we introduce new website functions, we begin using a newsletter, booking system, payment system or additional analytics, the third parties we use change, or legal or regulatory requirements change.

The date at the top shows when the notice was last updated.
